Terms and conditions

1. The free mock-up

One mock-up per business is produced free of charge and published on a test address.

It commits neither the client nor Kalibr. If the client does not proceed, the mock-up is taken off the server and no follow-up is made.

Until an order is placed, the mock-up and its code remain the property of Kalibr. They may not be reused, copied or passed to a third party.

The free mock-up does not apply to custom development, which is quoted after a call.

2. Offer and order

The price is set before work begins, on the basis of the scope stated in the offer. It does not change afterwards, unless additional work is agreed in writing.

An order is deemed placed on the client's written agreement; an email is sufficient.

3. Prices and payment

Prices exclude VAT and are in Swiss francs.

50% is due on order, the balance when the site goes live. Invoices are payable within ten days.

Work starts once the deposit is received. If the balance is unpaid, Kalibr may hold back the launch.

4. Lead times

Stated lead times are in working days and run from receipt of the deposit and of all necessary content.

They are suspended while waiting for an item or an approval from the client.

5. Content supplied by the client

The client warrants that they hold the rights to the text, photographs, logos and trademarks they supply, and is solely responsible for their content.

Kalibr may refuse content that is plainly unlawful or infringes third-party rights.

6. Revisions

Two rounds of revisions are included in the CHF 690 and CHF 1490 packages, three in the CHF 2900 package.

A round of revisions covers all the client's requests sent at one time.

Beyond that, changes are billed at CHF 120 per hour, in thirty-minute steps.

7. Delivery and ownership

The site is published on the client's own domain.

On payment in full, the code, the text written and the images produced for the site become the client's property, to use freely, including with another supplier.

Before payment in full, Kalibr retains the rights to all deliverables.

8. Domain and hosting

The domain and hosting are registered in the client's name, with the provider of their choice, and at their cost.

Kalibr is not liable for outages, data loss or price changes attributable to those providers.

9. Support after delivery

Thirty days of support are included after launch. They cover fixing faults, not enhancements or new content.

After that, work is charged at the hourly rate or under the care plan.

10. Reference

Unless the client objects in writing, Kalibr may name the engagement, show a screenshot on its own site and social accounts, and place a discreet credit in the footer of the delivered site.

That credit is removed on request, free of charge.

11. Liability

Kalibr works to the usual standards of the trade. Its liability is limited to the amount of the engagement concerned.

No commercial result, search engine ranking or citation by a conversational assistant is guaranteed.

12. Stopping the project

If the client stops the project after ordering, the work already done remains payable and the deposit is not refunded.

If the client is unreachable for more than sixty days, the engagement is deemed suspended and may be closed, the deposit remaining with Kalibr.

13. Governing law

These terms are governed by Swiss law. The place of jurisdiction is Kalibr's registered seat, subject to mandatory rules.
